To the Non-Governmental Organizations
The Ministry of Justice notifies that on July 19, 2005 the Law of the Republic of Belarus On Entering Changes and Additions to the Law of the Republic of Belarus On Non-Governmental Organizations was adopted and came into effect on October 29, 2005.
Please be informed that since entering the new version of such mentioned Law of the Republic of Belarus On Non-Governmental Organizations into effect (hereinafter the Law) the non-governmental organizations, unions (associations) may be involved in business undertakings only through establishing commercial organizations and/or participation in the same (Article 20).
According to Article 24, any NGO shall notify the Recording Office of any meetings of its higher body at least within seven days, and submit, to such Recording Office, necesary information on any changes of its elected bodies, not later than within ten days after making an appropriate decision.
Part six Article 24 in the Law contains the list of data to be annually submitted by any NGO not later than by March 1.
The Law has introduced certain additional requirements to the contents of the Statutes of NGOs. In particular, the Statute of any NGO shall, inter alia, contain the following: subject of activities; name; composition; election procedure; procedure and regularity of convening and time of authorities of the bodies of any NGO and of its organizational subdivisions; terms of reference thereof; procedure of making decisions by the NGO bodies and appealing against the same; extent of disposal of the NGO's property; structure of the association; terms and procedure of creation and cessation of activities of its organizational subdivisions; list of NGO's members; etc.
According to Article 4 of the Law, non-governmental organizations, unions (associations) registered prior to coming this Law into effect shall bring their constituent documents in conformity with the Law not later than within a year. The Law also containes other new provisions.
